GENERAL TERMS AND CONDITIONS OF SALE – CONSUMER CLIENTS

Article 1. PURPOSE

These General Terms and Conditions of Sale (hereinafter the “GTC”) aim to definethe reciprocal terms and obligations between GROSBUSCH S.A. (hereinafter“Grosbusch”) and its consumer clients within the meaning of the LuxembourgConsumer Code (hereinafter the “Client”), whether sales are concluded remotely(Webshop), in physical stores, or through a workplace delivery service via partnercompanies operating a concierge system under an agreement with Grosbusch.

Article 2. SCOPE AND BINDING NATURE

The GTC apply without restriction or reservation to all orders placed by the Client onthe Webshop, in-store, or at a workplace delivery point within the framework of aconcierge partnership.

 

Placing an order or making a purchase implies the Client’s full and unconditionalacceptance of these GTC. No special terms from the Client may prevail over theseGTC unless expressly accepted by Grosbusch.

Article 3. ORDER

3.1 Ordering Methods
Orders may be placed via the Webshop, in-store, or through a partner company’s concierge system. An electronic confirmation or receipt is issued following the purchase or order.

 

3.2 No Right of Withdrawal for Perishable Goods
In accordance with Article L.222-9 of the Luxembourg Consumer Code, the right ofwithdrawal does not apply to perishable products such as fruits and vegetables soldby Grosbusch. Once the order is confirmed, it is considered firm and final.

 

3.3 Modification or Cancellation of Order
Any request for modification must be approved by Grosbusch prior to pickup ordelivery. For concierge orders, any cancellation or modification must comply with thedeadlines specified in the agreement between Grosbusch and the partner company.

Article 4. PRICES

Prices are displayed in euros, including all taxes. In-store, the prices displayed onshelves prevail. For workplace deliveries, prices may be communicated via adedicated catalog or Webshop according to the partnership terms. The total priceincluding delivery fees is displayed before order confirmation.

Article 5. PRODUCTS

The essential characteristics of the products are indicated on the Webshop productpages or on in-store labeling. Products are presented as accurately as possible.However, errors may occur and cannot engage Grosbusch’s liability. Availability isindicative until order confirmation and may vary depending on the sales channel.

 

In case of subsequent unavailability, the Client will be informed and may choose areplacement if possible or a refund.

Article 6. RECEIPT OF PRODUCTS

In-store, the Client is invited to immediately check their purchases.For concierge or delivery, the Client must inspect the condition of the products uponreceipt and report any non-conformity immediately or within 48 hours to Grosbusch’scustomer service at shop@grosbusch.lu.

Article 7. PAYMENT

Online: payment upon order by credit card or any other offered means.
In-store: payment at the checkout.
Concierge: terms set in the agreement with the partner company.

Article 8. TRANSFER OF OWNERSHIP AND RISK

Ownership transfers upon physical delivery of the products. Risks transfer at that time.

Article 9. LEGAL WARRANTIES

Products benefit from:

  • The legal conformity warranty of 2 years (Consumer Code), insofar as it is compatible with the perishable nature of the delivered products;
  • Warranty against hidden defects (Civil Code). These warranties apply at no cost to the Client.

Article 10. LIABILITY

Grosbusch’s liability cannot be engaged in case of misuse or improper storage of the products by the Client.

Article 11. PERSONAL DATA

Personal data is processed in accordance with the GDPR and the privacy policy available at www.grosbusch.lu.

Article 12. MEDIATION AND DISPUTES

In case of dispute, the Client may contact our Customer Service or resort to a consumer mediator. Luxembourg law applies. The competent courts are those provided for by law.
